Privacy policy for clients

This statement describes how Profitax Steuerberatung GmbH, Biberstraße 22 1010 Vienna, ("we") process your personal data. The declaration is aimed at our existing and former clients, interested parties and potential future clients, as well as their respective shareholders, executive bodies and other employees.

1. Purposes of data processing

We will process your personal data for the following purposes:

  • To establish, manage and conduct the business relationship;

  • to inform you about current legal developments and our range of services;

  • in the case of an existing engagement for the internal organization of the law firm

and insofar as instructed by the client:

  • to carry out financial and business accounting for clients;

  • to provide advice and representation in the area of tax law and commercial matters;

  • to advise and represent clients in matters relating to social security contributions, insurance and benefits,

  • to represent clients before administrative courts and administrative authorities and before legally recognized churches and religious communities in contribution matters and before all other official institutions and

  • to provide other advice and to assume fiduciary duties and to manage assets within the scope of authorization under Section 2 WTBG 2017,

  • as well as for any task commissioned in accordance with Section 2 WTBG 2017

Insofar as we collect your personal data from you, the provision of your data is generally voluntary. However, if you do not provide your personal data, we will not be able to fulfill our mandate or will not be able to fulfill it completely.

2. Legal bases of the processing

If you are an interested party or potential future client, we will only process your contact data by sending you electronic mail or contacting you by telephone with your consent in accordance with Art. 6 para. 1 lit. a of the General Data Protection Regulation ("GDPR").

If you are our client, we process your personal data because this is necessary to fulfill the contract concluded with you (Art. 6 para. 1 lit. b GDPR).

Otherwise, we process your personal data on the basis of our overriding legitimate interest in achieving the purposes mentioned under point 1 (Art. 6 para. 1 lit. f GDPR) and on the legal basis of the WTBG 2017 (Art. 9 para. 2 lit. g GDPR).

3. Transmission of your personal data

Insofar as this is absolutely necessary for the purposes mentioned under point 1, we will transfer your personal data to the following recipients

  • Administrative authorities, courts and bodies governed by public law,

  • Public accountants for auditing purposes,

  • Insurance companies on the occasion of the conclusion of an insurance contract for the service or the occurrence of an insured event (e.g. liability insurance),

  • clients, insofar as this concerns data of the shareholders, executive bodies and other employees of the respective client,

  • IT service providers used by us,

  • cooperation partners and legal representatives working for us,

  • other recipients specified by the client (e.g. lawyers, notaries, banks, group companies of the client),

  • additionally, in the area of financial and business accounting for clients:

    • Debt collection agencies for debt recovery,

    • Banks on behalf of the client,

    • factoring companies, assignees and leasing companies.

    • Some of the above recipients may be located outside Austria or process your personal data outside Austria. The level of data protection in other countries may not be the same as in Austria.

4. Storage period

We generally store your personal data until the end of the business relationship in the context of which we have collected your data or until the expiry of the applicable statutory limitation and retention periods; in addition, until the end of any legal disputes in which the data is required as evidence. If you are a client, former client, interested party or potential future client or a contact person at one of the aforementioned, we will store your personal data for the purposes of contacting you (e.g. newsletter) until you object or withdraw your consent, provided that this measure is based on your consent.

5. Your rights in connection with personal data

Among other things, you are entitled (i) to check whether and which personal data we process about you and to receive copies of this data, (ii) to request the correction, addition or deletion of your personal data if it is incorrect or is not processed in accordance with the law, (iii) to request us to restrict the processing of your personal data, (iv) in certain circumstances, to object to the processing of your personal data or to withdraw the consent previously given for the processing, whereby a withdrawal does not affect the lawfulness of the processing carried out prior to the withdrawal, (v) to request data portability if you are our client, (vi) to know the identity of third parties to whom your personal data is transferred and (vii) to lodge a complaint with the data protection authority.
